These General Terms and Conditions (GTC) govern the business relationship between Putz24 GmbH and the customer. General Terms and Conditions (GTC) for final cleaning
<\/strong>Final cleaning of apartments & offices<\/em><\/p>

1. general<\/strong><\/p>

1.1 Scope of application<\/strong>
These General Terms and Conditions (GTC) apply to all contracts concluded between Putz24 GmbH<\/strong>, Bundesplatz 14, 6300 Zug (hereinafter “Service Provider”) and its customers (hereinafter “Customer”) for one-off final cleaning services.<\/p>

1.2 Conclusion of contract<\/strong>
The contract is concluded when the client books a final cleaning on the service provider’s website and completes the configurator in full. When submitting the form, the client is asked to accept these General Terms and Conditions. By confirming the booking, the client immediately enters into a binding contract with the service provider. The order is automatically confirmed directly by e-mail and the client receives the order confirmation including the General Terms and Conditions.
In addition:<\/strong> The client is shown all costs incurred directly on the website.<\/p>

1.3 Amendments to the GTC<\/strong>
The Service Provider reserves the right to amend these GTC at any time. The Client shall be notified of any amendments in good time before they come into force and shall be deemed to have accepted them if the Client does not object within 14 days. <\/p>

2. service description<\/strong><\/p>

2.1 Scope of services<\/strong>
The service provider shall provide the following one-off cleaning services:
– Final cleaning in accordance with the order confirmation, which was carried out using the configurator on the website.<\/strong><\/p>

2.2 Service period<\/strong>
The final cleaning shall be carried out at the time specified in the contract. Changes must be made in writing. <\/p>

2.3 Cancellation clause<\/strong>
The service provider reserves the right not to fulfill the contract in the event of staff shortages or allocation difficulties and to cancel the search or the contract at any time. The client shall be informed immediately in such a case. <\/p>

3. prices and payment<\/strong><\/p>

3.1 Pricing<\/strong>
The prices for the service are set out in the enclosed order confirmation. All prices are exclusive of VAT<\/strong>, unless otherwise agreed. <\/p>

3.2 Terms of payment<\/strong>
Clients have the option of choosing between several payment options. Additional fees may apply for credit card payments or TWINT payments. Invoices are due net within ten days of the invoice date without deduction. For larger orders, an agreement on advance payments can be made.
In addition:<\/strong> A fee of CHF 50.00 is due on the 2nd reminder.<\/p>

4 Contract duration and termination<\/strong><\/p>

4.1 Contract duration<\/strong>
This contract is limited to the duration of the one-off service and ends automatically after the agreed services have been provided in full.
As we only offer one-off cleaning assignments, the contract duration ensures that this contract cannot be terminated immediately after cleaning.<\/p>

4.2 Termination<\/strong>
Early termination is only possible for good cause and must be made in writing. The right to extraordinary termination remains unaffected.
In the event of cancellation by the client, the service provider is entitled to demand the full agreed amount<\/strong><\/p>

5. liability<\/strong><\/p>

5.1 Liability of the service provider<\/strong>
The service provider is liable for damages caused by gross negligence or intent. Liability for slight negligence is excluded. <\/p>

5.2 Exclusion of liability<\/strong>
The service provider shall not be liable for damage caused by force majeure, unforeseeable events or by the client itself.<\/p>

5.3 Acceptance guarantee<\/strong>
Without acceptance guarantee:<\/strong>
Unless the client has booked an additional acceptance guarantee in accordance with the order confirmation, the service provider assumes no liability for any complaints or defects that are discovered after acceptance of the apartment or property by the client or third parties.<\/p>

With acceptance guarantee:<\/strong>
If the client has booked an acceptance guarantee in accordance with the order confirmation, he undertakes to check the cleaning carried out immediately and to report any defects in writing within seven (7) days of acceptance of the apartment. After expiry of this period, the service provider shall no longer accept any responsibility for complaints. <\/p>

6. insurance
<\/strong>The service provider has public liability insurance amounting to CHF 5,000,000. This insurance covers damages arising in the course of the execution of the contract. <\/p>

7. personnel
<\/strong>The Service Provider reserves the right to deploy qualified personnel to perform the services. The Service Provider shall ensure that the personnel deployed are appropriately trained and qualified. <\/p>

8. responsibility of the client
<\/strong>The client undertakes to contribute to the fulfillment of the contract as far as possible. This includes, in particular, guaranteeing access to the property to be cleaned for the cleaning personnel at the agreed time. <\/p>

9. confidentiality
<\/strong>Both parties undertake to treat all confidential information obtained in the context of the contractual relationship as strictly confidential and not to disclose it to third parties. This includes, in particular, documents, personal data and information on residence, income and ownership. The client acknowledges that he is also subject to a duty of confidentiality with regard to business secrets. Business secrets are all information whose disclosure could harm the service provider or its employees in any way. This obligation of confidentiality shall remain in force even after termination of the contractual relationship. <\/p>

10. non-competition
<\/strong>The client is prohibited from enticing away or competing with the service provider’s employees on its own account or on behalf of third parties without the express written consent of the service provider. This includes in particular the brokering or conclusion of business relationships with the service provider’s employees. Even after termination of the contractual relationship, the client may not directly or indirectly employ the service provider’s employees within one year and in the business areas in which the service provider is active. <\/p>

11. contractual penalty
<\/strong>If the Client breaches the provisions on confidentiality (Art. 9) or the non-competition clause (Art. 10), it undertakes to pay a contractual penalty of CHF 2,000.00<\/g> for each individual breach. In addition, the client shall be fully liable for all further damages.
Payment of the contractual penalty shall not release the client from the obligation to comply with the contractual obligations.
The service provider shall be entitled to demand that the breach be remedied and that the duty of confidentiality and the non-competition clause be complied with in the future. <\/p>

12. amendments and additions
<\/strong>Amendments and additions to this contract must be made in writing and require the mutual consent of the contracting parties.<\/p>

13 Place of jurisdiction and applicable law<\/strong><\/p>

13.1 Place of jurisdiction<\/strong>
The parties agree that Zug<\/strong> shall be the exclusive place of jurisdiction for all disputes arising from or in connection with this contract.<\/p>

13.2 Applicable law<\/strong>
This contract is governed exclusively by Swiss law.<\/p>

14. severability clause
<\/strong>Should individual provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions. The parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the economic purpose of the invalid provision. <\/p>

15. final provisions
