General Terms and Conditions (GTC) for Window Cleaning Services

Putz24.ch is a brand of Menum GmbH, Bächigenstrasse 18, 9212 Arnegg, Switzerland. These General Terms and Conditions (GTC) govern the business relationship between Putz24.ch and its customers. By booking our services, the customer agrees to the following terms and conditions.

Window Cleaning for Private Households, Offices, and Properties

1. General Provisions

1.1 Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded between Putz24, a brand of Menum GmbH, Bächigenstrasse 18, 9212 Arnegg (hereinafter referred to as the “Service Provider”), and its customers (hereinafter referred to as the “Client”) for window cleaning services.

1.2 Conclusion of Contract
The contract is concluded when the Client books a window cleaning service on the Service Provider’s website and completes the configurator. Upon submission of the form, the Client is required to accept these General Terms and Conditions. By confirming the booking, the Client enters into a binding contract with the Service Provider. A booking confirmation is automatically sent by email and includes the GTC.
Additionally: All associated costs are transparently displayed on the website.

1.3 Amendments to the GTC
The Service Provider reserves the right to amend these GTC at any time. Changes will be communicated to the Client in advance and are deemed accepted unless the Client objects within 14 days.

2. Description of Services

2.1 Scope of Services
The Service Provider offers the following window cleaning services:
Cleaning of interior and exterior window surfaces in accordance with the booking confirmation generated via the configurator on the website.

2.2 Safety Measures
The Service Provider commits to adhering to all necessary safety measures when performing window cleaning services, especially when working at heights.

2.3 Timeframe of Services
The window cleaning will be carried out on the date specified in the contract. Any changes must be agreed upon in writing.

2.4 Cancellation Clause
The Service Provider reserves the right to cancel the contract in the event of staff shortages or allocation issues. In such cases, the Client will be informed immediately.

3. Prices and Payment

3.1 Pricing
The prices for the services are based on the attached booking confirmation. All prices are exclusive of VAT.

3.2 Payment Terms
Clients may choose between multiple payment methods. Additional fees may apply for credit card or TWINT payments. Invoices must be paid net within ten days of the invoice date, without deductions. For larger jobs, an advance payment agreement may be arranged.
Additionally: A fee of CHF 50.00 will be charged upon the second reminder.

4. Contract Duration and Termination

4.1 Duration
This contract is limited to a one-time service and automatically ends after the agreed service has been fully provided.
As we only offer one-time cleaning services, the contract duration ensures that the contract cannot be terminated immediately after the cleaning is completed.

4.2 Termination
Early termination is only permitted for good cause and must be in writing. The right to extraordinary termination remains unaffected.
In the event of cancellation by the Client, the Service Provider is entitled to claim the full agreed amount.

5. Liability

5.1 Liability of the Service Provider
The Service Provider is liable for damages caused by gross negligence or intent. Liability for slight negligence is excluded.

5.2 Exclusion of Liability
The Service Provider is not liable for damages resulting from force majeure, unforeseeable events, or damages caused by the Client.

6. Insurance
The Service Provider maintains a business liability insurance policy of CHF 5,000,000. This insurance covers damages arising during contract performance.

7. Personnel
The Service Provider reserves the right to use qualified personnel to perform the services. The Service Provider ensures that all staff are appropriately trained and qualified.

8. Client Responsibilities
The Client undertakes to contribute to the fulfilment of the contract to the best of their ability. This includes especially providing access to the premises to be cleaned at the agreed time.

9. Confidentiality
Both parties agree to keep all confidential information obtained during the course of the contractual relationship strictly confidential and not to disclose it to third parties. This includes documents, personal data, and information about housing, income, or ownership.
The Client acknowledges they are also subject to confidentiality regarding business secrets. Business secrets include any information whose disclosure could harm the Service Provider or its employees. This obligation remains in effect even after the contract ends.

10. Non-Compete Clause
The Client is prohibited, without express written consent of the Service Provider, from hiring or soliciting employees of the Service Provider for personal use or on behalf of third parties. This includes initiating or concluding business relationships with such employees. Even after termination of the contract, the Client may not employ Service Provider personnel within one year in the same business fields, either directly or indirectly.

11. Contractual Penalty
If the Client violates the confidentiality (Art. 9) or non-compete provisions (Art. 10), they agree to pay a contractual penalty of CHF 2,000.00 per violation.
In addition, the Client is liable for any further damages.
Payment of the penalty does not release the Client from their contractual obligations.
The Service Provider reserves the right to demand elimination of the violation and continued compliance with confidentiality and non-compete obligations.

12. Amendments and Additions
Amendments and additions to this contract must be made in writing and mutually agreed upon by both parties.

13. Jurisdiction and Applicable Law

13.1 Jurisdiction
For all disputes arising from or in connection with this contract, the parties agree to St. Gallen, Switzerland, as the exclusive place of jurisdiction.

13.2 Applicable Law
This contract is governed exclusively by Swiss law.

14. Severability Clause
Should any provision of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. The parties undertake to replace the invalid provision with one that most closely reflects its economic purpose.

15. Final Provisions
This contract contains the entire agreement between the parties and supersedes all prior oral and written agreements.
