General Terms and Conditions (GTC) for Final Cleaning Services
Putz24.ch is a brand of Menum GmbH, Bächigenstrasse 18, 9212 Arnegg, Switzerland. These General Terms and Conditions (GTC) govern the business relationship between Putz24.ch and its customers. By booking our services, the customer agrees to the following terms and conditions.

Final Cleaning of Apartments & Office Spaces

1. General Provisions

1.1 Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded between Putz24, a brand of Menum GmbH, Bächigenstrasse 18, 9212 Arnegg (hereinafter referred to as the “Service Provider”) and its customers (hereinafter referred to as the “Client”) for one-time final cleaning services.

1.2 Conclusion of Contract
The contract is concluded when the Client books a final cleaning service via the Service Provider’s website and completes the configurator. Upon submission of the form, the Client is prompted to accept these GTC. By confirming the booking, the Client enters into a binding contract with the Service Provider. The booking confirmation is sent automatically by email and includes the General Terms and Conditions.
Additionally: All costs are transparently displayed to the Client on the website.

1.3 Changes to the GTC
The Service Provider reserves the right to amend these GTC at any time. Changes will be communicated to the Client in a timely manner before they take effect and shall be deemed accepted unless the Client objects within 14 days.

2. Description of Services

2.1 Scope of Services
The Service Provider performs the following one-time cleaning services:
– Final cleaning according to the booking confirmation generated via the configurator on the website.

2.2 Timeframe of Services
The final cleaning will be performed at the date specified in the contract. Any changes must be made in writing.

2.3 Cancellation Clause
The Service Provider reserves the right to cancel the contract in the event of personnel shortages or allocation difficulties. In such a case, the Client will be informed immediately.

3. Prices and Payment

3.1 Pricing
The service prices are outlined in the attached booking confirmation. All prices are exclusive of VAT unless otherwise agreed.

3.2 Payment Terms
Clients can choose from multiple payment methods. Additional charges may apply for credit card or TWINT payments. Invoices must be paid net within ten days from the invoice date without deductions. For larger assignments, an advance payment agreement may be made.
Additionally: A fee of CHF 50.00 will be charged with the second reminder notice.

4. Contract Duration and Termination

4.1 Duration
This contract is limited to the one-time service and automatically ends upon full delivery of the agreed services.
As the service is a one-time final cleaning, the contract ensures that it cannot be terminated immediately after the service has been performed.

4.2 Termination
Early termination is only permitted for just cause and must be in writing. The right to extraordinary termination remains unaffected.
In the event of cancellation by the Client, the Service Provider is entitled to charge the full agreed amount.

5. Liability

5.1 Liability of the Service Provider
The Service Provider is liable for damages caused by gross negligence or intent. Liability for slight negligence is excluded.

5.2 Exclusion of Liability
The Service Provider is not liable for damages resulting from force majeure, unforeseeable events, or those caused by the Client.

5.3 Acceptance Guarantee
Without acceptance guarantee:
If the Client has not booked an acceptance guarantee as part of the booking confirmation, the Service Provider is not liable for complaints or deficiencies reported after acceptance of the cleaned property by the Client or third parties.

With acceptance guarantee:
If the Client has booked an acceptance guarantee, they are obliged to inspect the cleaning immediately and report any deficiencies in writing within seven (7) days after acceptance. After this period, the Service Provider assumes no responsibility for complaints.

6. Insurance
The Service Provider holds business liability insurance in the amount of CHF 5,000,000. This insurance covers damages that arise during the execution of the contract.

7. Personnel
The Service Provider reserves the right to deploy qualified personnel to perform the services. The Service Provider ensures that all personnel used are properly trained and qualified.

8. Client Responsibilities
The Client agrees to contribute to the fulfilment of the contract to the extent possible. This includes, in particular, ensuring that access to the premises is available to the cleaning personnel at the agreed time.

9. Confidentiality
Both parties agree to treat all confidential information obtained in connection with this contract as strictly confidential and not to disclose it to third parties. This includes documents, personal data, and information regarding living, income, and ownership conditions.
The Client acknowledges that they are also subject to confidentiality with regard to trade secrets. Trade secrets include all information whose disclosure could in any way harm the Service Provider or its employees. This confidentiality obligation continues even after the termination of the contractual relationship.

10. Non-Compete Clause
The Client is prohibited from soliciting or employing the Service Provider’s staff for their own account or on behalf of third parties without prior written consent. This includes arranging or concluding business relationships with such staff. Even after the contract ends, the Client may not directly or indirectly employ any of the Service Provider’s staff within one year and in the same business areas.

11. Contractual Penalty
If the Client breaches the confidentiality clause (Art. 9) or the non-compete clause (Art. 10), they agree to pay a contractual penalty of CHF 2,000.00 per violation.
The Client is also liable for any further damages incurred.
Payment of the penalty does not release the Client from complying with the contractual obligations.
The Service Provider is entitled to demand the elimination of the violation and future compliance with the confidentiality and non-compete obligations.

12. Amendments and Additions
Any amendments or additions to this contract must be made in writing and agreed upon by both parties.

13. Jurisdiction and Applicable Law

13.1 Jurisdiction
The exclusive place of jurisdiction for all disputes arising out of or in connection with this contract shall be St. Gallen, Switzerland.

13.2 Applicable Law
This contract is governed exclusively by Swiss law.

14. Severability Clause
Should individual provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. The parties agree to replace the invalid provision with a valid one that comes closest to the economic purpose of the invalid provision.

15. Final Provisions
This contract contains all agreements between the parties and supersedes all previous oral and written agreements.
