General Terms and Conditions (GTC) for Property Cleaning Services

Putz24.ch is a brand of Menum GmbH, Bächigenstrasse 18, 9212 Arnegg, Switzerland. These General Terms and Conditions (GTC) govern the business relationship between Putz24.ch and its customers. By booking our services, the customer agrees to the following terms and conditions.

General Terms and Conditions (GTC) for Property Cleaning
Private Households & Office Cleaning

1. General Provisions

1.1 Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded between Putz24, a brand of Menum GmbH, Bächigenstrasse 18, 9212 Arnegg (hereinafter referred to as the “Service Provider”) and its customers (hereinafter referred to as the “Client”) for cleaning services in private homes and office buildings.

1.2 Conclusion of Contract
The contract is concluded when the Client books a property cleaning service on the Service Provider’s website and fully completes the configurator. Upon submitting the form, the Client is asked to accept these GTC. By confirming the booking, the Client immediately enters into a binding contract with the Service Provider.
All applicable costs are transparently displayed on the website. A booking confirmation is automatically sent to the Client by email and includes these General Terms and Conditions.

1.3 Amendments to the GTC
The Service Provider reserves the right to amend these GTC at any time. Changes will be communicated to the Client in a timely manner before they take effect and are deemed accepted unless the Client objects within 14 days.

2. Description of Services

2.1 Scope of Services
The Service Provider provides the following cleaning services:

  • Private households: Regular maintenance cleaning as defined in a separate task agreement.

  • Office cleaning: Recurring cleaning services as defined in a separate task agreement.

2.2 Service Period
The exact scope and schedule of services are outlined in the booking confirmation generated through the configurator. Any changes must be made in writing.

2.3 Cancellation Clause
The Service Provider reserves the right to cancel the contract in the event of staffing shortages or assignment difficulties. In such a case, the Client will be informed immediately.

3. Prices and Payment

3.1 Pricing
Prices for the services are based on the attached booking confirmation No. A23455. All prices are exclusive of VAT.

3.2 Payment Terms
Clients can choose from various payment options. Additional charges may apply for credit card or TWINT payments. Invoices must be paid within ten days net from the invoice date, without deductions. For larger jobs, an advance payment agreement may be made.
Additionally: A CHF 50.00 fee will be charged upon the second reminder notice.

4. Contract Duration and Termination

4.1 Duration
This contract is concluded for an indefinite period. A trial period of three months applies, during which termination is not permitted. After the trial period ends, the contract can be terminated at the end of any month.
As we only offer recurring cleaning services, the trial period ensures the contract cannot be canceled immediately after a single cleaning.

4.2 Termination
Termination must be made in writing. The right to extraordinary termination for just cause remains unaffected.

5. Liability

5.1 Liability of the Service Provider
The Service Provider is liable for damages caused by gross negligence or intent. Liability for slight negligence is excluded.

5.2 Exclusion of Liability
The Service Provider is not liable for damages caused by force majeure, unforeseeable events, or damages attributable to the Client.

6. Insurance
The Service Provider maintains a business liability insurance policy of CHF 5,000,000. This insurance covers damages arising in the course of contract execution.

7. Personnel
The Service Provider reserves the right to employ qualified personnel for the performance of services. The Service Provider ensures that the deployed staff is properly trained and qualified.

8. Key Handling
If the Client decides to provide keys to Putz24 personnel, this is done at the Client’s own risk. The Client releases Putz24 from any liability in case of loss or theft. It is the Client’s responsibility to inform Putz24 immediately of any key loss to prevent further risk.

9. Client Responsibilities
The Client agrees to contribute to fulfilling the contract to the best of their ability. This includes ensuring access to the premises at the agreed time. The Client is also responsible for providing all necessary cleaning equipment and materials.

10. Confidentiality
Both parties agree to treat all confidential information obtained during the contractual relationship as strictly confidential and not to disclose such information to third parties. This includes documents, personal data, and information regarding living, income, or ownership conditions.
The Client acknowledges being subject to a duty of confidentiality regarding trade secrets. Trade secrets include all information whose disclosure could harm the Service Provider or its employees in any way. This confidentiality obligation continues even after the contract has ended.

11. Non-Compete Clause
The Client is prohibited from soliciting or employing the Service Provider’s staff, either for personal use or on behalf of third parties, without prior written consent. This includes initiating or concluding business relationships with such employees. Even after the contractual relationship ends, the Client may not employ such staff, directly or indirectly, for one year within the Service Provider’s areas of operation.

12. Contractual Penalty
If the Client breaches the confidentiality (Art. 10) or non-compete (Art. 11) provisions, they agree to pay a contractual penalty equal to the average value of services rendered over the last six months for each individual violation.
In addition, the Client is fully liable for any damages beyond this amount.
Payment of the penalty does not release the Client from their contractual obligations. The Service Provider reserves the right to demand elimination of the violation and continued compliance with all terms.

13. Amendments and Additions
Amendments or additions to this contract must be made in writing and agreed upon by both parties.

14. Jurisdiction and Applicable Law

14.1 Jurisdiction
For all disputes arising from or in connection with this contract, the parties agree to the exclusive jurisdiction of St. Gallen, Switzerland.

14.2 Applicable Law
This contract is governed exclusively by Swiss law.

15. Severability Clause
Should any provision of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. The parties agree to replace the invalid provision with one that most closely reflects its original economic intent.

16. Final Provisions
This contract contains the entire agreement between the parties and supersedes all prior oral and written agreements.
